(KTTS News) — A judge has issued a partial ruling on a controversial development in the works at the corner of Sunshine and National in Springfield.
The developer, Be Kind and Merciful, wants to rezone the land from single-family to general retail, even though the University Heights Neighborhood Association claims a 100-year-old deed prevents the construction of anything that is not a residential home.
The judge says he will rule on the deed restrictions later this month.
It will be up to Springfield Planning and Zoning to handle the rezoning case.
